Terms of Service

Effective from 10 January 2026

1. Introduction

Welcome to Looties. These Terms of Service ("Terms") govern your access to and use of the Looties website and mobile application (the "Service"). The Service is operated by Looties, a sole proprietorship (entreprise individuelle) registered in France under number 89279633500024, with its registered office at 10 allée des champs Carteron, 74600 Annecy. ("Looties", "we", "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. Transactions on Looties are carried out between private individuals acting in a non-professional capacity. Looties acts solely as an intermediary.

2. Status of Looties (Hosting Provider)

Looties acts exclusively as a Hosting Provider (Hébergeur) pursuant to Article 6-I-2 of the French Law on Confidence in the Digital Economy (LCEN).

  • We provide a platform for users to list and buy items.
  • We are not a party to any transaction between buyers and sellers.
  • We do not buy, sell, or take possession of the items listed.
  • We do not verify the authenticity, quality, safety, or legality of any items listed.

3. Eligibility

You must be at least 18 years old to use Looties. By using the Service, you represent and warrant that you have the legal capacity to enter into a binding contract.

4. Buying and Selling

4.1. Listings and Seller Obligations

  • Legality:You are solely responsible for ensuring that any item you list is legal to sell and does not violate any applicable laws or third-party rights (including Intellectual Property rights).
  • No Counterfeits:Although Looties does not proactively control for counterfeits, the sale of counterfeit items is strictly prohibited by law. You represent that you are the legal owner of every item you list.
  • Description:You must describe your items honestly and accurately. You are responsible for any error or omission in your listing.
  • Prohibited Items:While we do not maintain an exhaustive list of prohibited items, we reserve the right to remove any listing that we deem inappropriate, illegal, or unsafe at our sole discretion, without prior notice or compensation.
  • Ranking:By default, listings on Looties are displayed in reverse chronological order based on their date of publication (newest items first).
  • Minimum Price:All new listings must have a minimum price of 1,00 € EUR.

4.2. Shipping

Sellers are responsible for packaging and shipping items in compliance with carrier requirements, including minimum parcel dimensions and weight limits. Parcels that do not meet carrier requirements may be refused by carriers or drop-off points.

Delivery times and shipping methods are arranged directly between the Buyer and Seller. Looties is not responsible for non-delivery, delay, or damage during transit.

DDU Shipping: All shipments are DDU (Delivered Duty Unpaid). Buyers are responsible for any customs duties, taxes, or fees imposed by their country. Looties does not collect or remit customs duties or import taxes.

4.3. Buyer Protection

Eligible orders placed on Looties include Looties Buyer Protection, which is automatically applied by default, mandatory, and cannot be opted out of. Coverage conditions depend on the carrier and shipping service selected for the order.

Buyer Protection is provided in partnership with a third-party insurance provider. Looties facilitates access to this protection but does not itself insure parcels and does not guarantee claim outcomes.

The scope of coverage, exclusions, and claims process are described in the Looties Buyer Protection policy, available at https://looties.io/buyer-protection.

By accepting these Terms, you acknowledge and agree to be bound by the Looties Buyer Protection policy.

4.4. Absence of Right of Withdrawal

In accordance with Article L. 221-28 of the French Consumer Code, users are informed that the statutory right of withdrawal ("Droit de Rétractation") does not apply to transactions carried out between private individuals on Looties. Consequently, Buyers cannot invoke this right to demand a refund or return an item once the transaction is completed, except as mutually agreed with the Seller or as specified in our Refund Policy.

5. Payments

5.1. Stripe Connect and Fund Flow

Payment processing services on Looties are provided by Stripe via Stripe Connect Express accounts.

By using the Service, you agree to be bound by the Stripe Connected Account Agreement, which includes the Stripe Services Agreement (collectively, the "Stripe Agreements").

You acknowledge and agree that:

  • Looties is not a bank or payment institution and does not hold user funds.
  • All payments are processed and held by Stripe in the Seller's Stripe Connect account.
  • Looties shall not be liable for any interruption, delay, or error caused by Stripe's services.

5.2. Payout Policy

Looties applies a staged payout system designed to protect buyers and sellers and to reduce fraud and chargeback risk.

a) Fund Availability Delay

  • Funds from a completed sale do not become immediately available.
  • Funds become available fourteen (14) days after the order is completed, meaning:
    • the Buyer confirms delivery, or
    • the order is automatically completed after the applicable auto-completion period.
  • This delay allows time to detect and resolve refunds, disputes, or delivery issues.

b) Partial Availability Upon Completion

Once an order is completed:

  • Thirty-three percent (33%) of the sale amount becomes available for payout immediately, subject to Stripe processing.
  • Sixty-six percent (66%) of the sale amount is temporarily held as a security buffer.

c) Security Buffer

The security buffer:

  • Is not a fee and remains the Seller's money.
  • Exists to cover potential refunds, disputes, chargebacks, or reversals.
  • Is released fourteen (14) days after completion, provided no issue has been raised.

The buffer amount is calculated on a rolling basis and corresponds to approximately sixty-six percent (66%) of the value of funds that became available to the Seller during the previous thirty (30) days.

d) Manual Payout Requests

  • Payouts are not automatic.
  • Sellers must explicitly request a payout via their account interface.
  • Looties may limit payout amounts to ensure sufficient balance remains to cover unresolved transactions or disputes.
  • Minimum payout thresholds, processing times, and availability may vary depending on Stripe's requirements and Seller account status.

e) Disputes, Refunds, and Negative Balances

If a Buyer initiates a refund or dispute:

  • The corresponding amount may be deducted from the Seller's available or buffered balance.
  • If the Seller's balance becomes negative, Stripe may attempt to recover the amount using the Seller's linked external payment methods.

By using the Service, Sellers expressly authorize:

  • Automatic debit of their connected bank account or debit card to recover negative balances, in accordance with Stripe's policies.

Looties reserves the right to delay or suspend payouts if unresolved disputes or abnormal risk patterns are detected.

f) Instant Payouts

  • Instant payouts are disabled by default.
  • Looties may enable instant payouts for certain Sellers at its discretion, subject to additional eligibility criteria and risk controls.

6. Tax and Legal Obligations

Seller Tax Obligations (French Users): In accordance with French law, users are reminded that income generated from sales on digital platforms may be subject to tax and social security obligations. It is your responsibility to comply with applicable laws.

Import Duties and Customs: Looties does not collect VAT, import duties, or customs fees. All shipments are DDU (Delivered Duty Unpaid). Buyers may be subject to customs charges, import taxes, or duties imposed by their country upon delivery. These fees are the buyer's responsibility and are not included in the purchase price.

7. Cancellations and Refunds

Cancellations and refunds are governed by the applicable Looties platform policies, including the Refund & Cancellation Policy and, where relevant, the Looties Buyer Protection policy, as well as by the contractual relationship between the Buyer and Seller, subject at all times to Looties' rules.

8. Fees

Looties charges a service fee on all transactions. Fees are clearly displayed before you complete a purchase and are non-refundable.

Fee Structure:

  • Service Fee: 1,00 € fixed + 7% of the item price
  • Shipping: Actual cost calculated at checkout based on carrier rates

9. Disclaimer of Warranties and Limitation of Liability

9.1. "As Is" Service

The Service is provided "AS IS" and "AS AVAILABLE". We expressly disclaim all warranties of any kind, whether express or implied, including the availability of the site or the accuracy of user content.

9.2. Limitation of Liability

To the fullest extent permitted by applicable law (including French Consumer Law):

  • Looties shall not be liable for any indirect, incidental, special, or consequential damages.
  • Looties is not liable for the content posted by Users (including descriptions and photos) or the items sold.
  • Our total liability for any claim arising out of these Terms is limited to the total fees paid by you to Looties in the 12 months preceding the event giving rise to the claim.

10. Content Reporting

If you believe a listing violates the law (e.g., counterfeits, prohibited items), you may report it to us at support@looties.io. As a Hosting Provider, our obligation is limited to removing clearly illegal content upon receiving a valid notification.

11. Termination

We may terminate or suspend your access to the Service at any time, for any reason, without notice, particularly if we believe you have violated these Terms or applicable laws.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of France. In the event of a dispute, users and Looties shall first attempt to resolve the matter amicably. Failing that, the courts of Annecy shall have exclusive jurisdiction, subject to mandatory consumer protection laws.

APPENDIX

Appendix 1 - AI USAGE POLICY

1. Scope and Acceptance

This Appendix governs your use of the optional AI-powered tools made available on the Looties platform (the "AI Services"). By checking the consent box in the Terms of Service and/or accessing or using the AI Services, you acknowledge and agree to be bound by this Appendix. If you do not agree with these terms, you must not use the AI Services. You agree that your continued use of the AI Services constitutes acceptance of any future updates to this Appendix.

2. Transparency

In accordance with Article 50 of the EU AI Act, we inform you that when you use the AI Services, your content is processed by an artificial intelligence system.

Inputs

"Inputs" means any content you submit to the AI Services, including images, text, or other materials.

Outputs

"Outputs" means all results generated by the AI Services, which are artificially generated or modified.

Accuracy

AI systems are probabilistic by nature. Outputs may contain inaccuracies, artifacts, or unexpected results. You are solely responsible for reviewing, validating, and deciding whether to use or publish any Output.

3. Data License and Training

By enabling or using the AI Services, you explicitly consent to the following use of your data:

Processing License

By using the AI Services, you grant Looties and its third-party AI processors a worldwide, royalty-free, non-exclusive license to process your Inputs solely for the purpose of generating the Outputs and operating the AI Services.

Model Improvement

You acknowledge and agree that your Inputs and Outputs may be retained and used by Looties and its AI processors to train, validate, and improve AI models.

If you do not wish your data to be used for these purposes, you must not use the AI Services.

4. Ownership

Your Rights

You retain full ownership of your original Inputs and the resulting Outputs generated through the AI Services. You are free to use the Outputs outside of the Looties platform, without restriction.

No Claim

Looties claims no ownership over the intellectual property rights in the content you process using the AI Services.

5. Privacy Constraints

Lawful Content

You agree not to submit Inputs that violate applicable laws or third-party rights.

Prohibited Content

You agree not to upload content containing recognizable faces, biometric data, or sensitive personal information (as defined under the GDPR).

Processor Locations

Our AI providers may process data outside the European Union, including in the United States, under appropriate security safeguards such as Standard Contractual Clauses.

Lawful Use

You represent that you have all necessary rights and permissions to submit the Inputs to the AI Services.

6. Limitation of Liability

Looties provides the AI Services "AS IS" and without warranties of any kind. We are not liable for errors or omissions in processing, data loss, or intellectual property disputes arising from your use of the AI Services.
