Boutique Terms of Service

1. Scope and seller

These Boutique Terms of Service apply only to products identified as sold directly by Looties through the Looties Boutique. For those purchases, Looties is the seller and your contracting party. Looties' separate role as an intermediary for user-to-user marketplace transactions does not apply to a Boutique order.

Looties' legal identity and contact details are available in the Legal Notice.

2. Products, prices and territory

The essential characteristics and total price of each product are shown before checkout. Displayed prices include applicable taxes, if any. Standard delivery is included in the displayed product price.

Boutique orders are available only to authenticated customers with a delivery address in the European Union.

3. Order, payment and availability

You may review and correct your order before submitting it. An order becomes binding when Looties accepts it and sends an order confirmation by email.

Payment is collected through a secure third-party payment processor using the payment method selected at checkout. Looties may reject or cancel an order where payment is not authorized, the order appears fraudulent, or fulfillment is impossible. If Looties cancels a paid order, the amount collected will be refunded using the original payment method.

Boutique stock is managed in small quantities and an item may require restocking after an order is placed. Looties will inform you if an order cannot be fulfilled within the delivery timeframe communicated for the order. If fulfillment becomes impossible, Looties will cancel the affected item or order and refund the corresponding amount.

4. Delivery and risk

Looties delivers Boutique orders only within the European Union. Eligible French orders may offer pickup-point delivery; other supported destinations use home delivery.

Looties remains responsible for the goods until you, or a third party designated by you other than the carrier, takes physical possession of them.

5. Cancellation before dispatch

You may ask Looties to cancel a Boutique order before dispatch. Looties will cancel it where fulfillment can still reasonably be stopped.

If the order has already entered dispatch, the statutory withdrawal process below applies after delivery.

6. Statutory withdrawal

If you are a consumer, you may withdraw from a Boutique purchase without giving a reason within fourteen (14) calendar days after you, or a third party designated by you other than the carrier, receives the goods. For an order delivered in several shipments, the period starts when the last item is received.

You must notify Looties before the deadline by an unambiguous written statement sent to the contact address identified below. You may use the model form at the end of these Terms, but it is not mandatory. Merely refusing delivery or returning a parcel without a withdrawal statement is not sufficient.

7. Returning withdrawn goods

After notifying Looties, you must send the goods back without undue delay and no later than fourteen (14) calendar days after that notification. You bear the direct cost and transit risk of a convenience return.

Looties does not provide a free return label, exchange, or extended commercial return period. You should retain proof of shipment.

You may handle the goods only as necessary to establish their nature, characteristics, and functioning, as you reasonably could in a shop. You are responsible for any diminished value caused by handling beyond what is necessary for that assessment. Original packaging should be included where reasonably possible, but its absence does not by itself remove a statutory right.

8. Refunds after withdrawal

Looties will refund the payments received for the withdrawn goods, including any standard outbound delivery amount actually charged, no later than fourteen (14) days after being informed of the withdrawal.

Because standard Boutique delivery is currently included in the product price, no separate outbound delivery amount is normally refundable. Looties may withhold the refund until it receives the returned goods or you provide evidence that they were sent, whichever occurs first.

The refund uses the original payment method unless you expressly agree otherwise and will not incur a refund fee from Looties.

9. Incorrect, damaged or non-conforming goods

Convenience-return costs do not apply where Looties sent the wrong product or where goods are damaged or non-conforming. Contact Looties before returning such goods and provide the order reference and information reasonably needed to assess the issue.

Where a statutory remedy requires a return, Looties bears the necessary return cost. Depending on the applicable guarantee, the available remedy may be repair, replacement, a price reduction, or refund.

10. Legal guarantees and delivery loss

New goods sold by Looties benefit from the mandatory legal conformity guarantee for two (2) years from delivery and any applicable hidden-defect guarantee. These rights apply independently of withdrawal and cannot be reduced by these Terms.

Unless you independently appoint a carrier not offered by Looties, Looties remains responsible if the order is lost or damaged before physical delivery.

11. No additional commercial return right

Looties grants no voluntary return, free-return, exchange, store-credit, or satisfaction-guarantee right beyond the mandatory rights described above.

12. Related policies, priority and contact

Marketplace orders between users remain governed by the marketplace Terms of Service, the Refund & Cancellation Policy, and any applicable Buyer Protection terms.

If these Boutique Terms of Service conflict with a provision describing Looties solely as a marketplace intermediary or stating that Looties does not sell or possess goods, these Boutique Terms of Service prevail for the affected Boutique order. All other provisions of the Terms continue to apply where compatible with a direct sale.
