Marketplace Terms of Service

Effective from 6 October 2026

1. Introduction

Welcome to Looties. These Terms of Service ("Terms") govern your access to and use of the Looties website and mobile application (the "Service"). The Service is operated by Looties ("Looties", "we", "us"). Full company details are available on our Legal Notice page.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. Items on Looties are sold either by private individuals ("Private Sellers") or by businesses ("Pro Sellers", see Appendix 3). Each seller's status is shown on their profile, on their listings and at checkout. Looties acts solely as an intermediary.

2. Status of Looties (Hosting Provider)

Looties acts exclusively as a Hosting Provider (Hébergeur) pursuant to Article 6-I-2 of the French Law on Confidence in the Digital Economy (LCEN).

  • We provide a platform for users to list and buy items.
  • We are not a party to any transaction between buyers and sellers.
  • We do not buy, sell, or take possession of the items listed.
  • We do not verify the authenticity, quality, safety, or legality of any items listed.
  • We show whether a seller is a Private Seller or a Pro Seller, based on the seller's own declaration. When you buy from a Private Seller, the consumer protection rules that apply to purchases from a business, such as the right of withdrawal, do not apply.

3. Eligibility and Seller Status

3.1. Eligibility

You must be at least 18 years old to use Looties. By using the Service, you represent and warrant that you have the legal capacity to enter into a binding contract.

3.2. Seller Status

Every seller is a Private Seller by default. When you create your account, and at any time afterwards from your account settings, you can declare that you sell as a business. The law requires you to do so if you meet the criteria in Appendix 3. Looties does not change your status on its own. If you are unsure of your status or your situation changes, contact support@looties.io.

4. Buying and Selling

4.1. Listings and Seller Obligations

  • Legality:You are solely responsible for ensuring that any item you list is legal to sell and does not violate any applicable laws or third-party rights (including Intellectual Property rights).
  • No Counterfeits:Although Looties does not proactively control for counterfeits, the sale of counterfeit items is strictly prohibited by law. You represent that you are the legal owner of every item you list.
  • Description:You must describe your items honestly and accurately. You are responsible for any error or omission in your listing.
  • Prohibited Items:While we do not maintain an exhaustive list of prohibited items, we reserve the right to remove any listing that we deem inappropriate, illegal, or unsafe at our sole discretion, without prior notice or compensation.
  • Ranking:By default, listings on Looties are displayed in reverse chronological order based on their date of publication (newest items first).
  • Minimum Price:All new listings must have a minimum price of 1,00 € EUR.

4.2. Shipping

Sellers are responsible for packaging and shipping items in compliance with carrier requirements, including minimum parcel dimensions and weight limits. Parcels that do not meet carrier requirements may be refused by carriers or drop-off points.

Delivery times and shipping methods are arranged directly between the Buyer and Seller. Looties is not responsible for non-delivery, delay, or damage during transit.

DDU Shipping: All shipments are DDU (Delivered Duty Unpaid). Buyers are responsible for any customs duties, taxes, or fees imposed by their country. Looties does not collect or remit customs duties or import taxes.

4.3. Buyer Protection

Eligible orders placed on Looties include Looties Buyer Protection, which is automatically applied by default, mandatory, and cannot be opted out of. Coverage conditions depend on the carrier and shipping service selected for the order.

Buyer Protection is provided in partnership with a third-party insurance provider. Looties facilitates access to this protection but does not itself insure parcels and does not guarantee claim outcomes.

The scope of coverage, exclusions, and claims process are described in the Looties Buyer Protection policy, available at https://looties.io/buyer-protection.

By accepting these Terms, you acknowledge and agree to be bound by the Looties Buyer Protection policy.

4.4. Right of Withdrawal

The statutory right of withdrawal ("Droit de Rétractation") applies only to purchases from a business. It does not apply to a purchase from a Private Seller: once the transaction is completed, you cannot return the item or ask for a refund on that basis, except as agreed with the Seller or as provided in our Refund Policy and Buyer Protection.

When you buy from a Pro Seller, you have fourteen (14) days after delivery to withdraw for any reason, and you benefit from the legal guarantees. Both are described in Appendix 3.

5. Payments

5.1. Stripe Connect and Fund Flow

Payment processing services on Looties are provided by Stripe via Stripe Connect Express accounts.

By using the Service, you agree to be bound by the Stripe Connected Account Agreement, which includes the Stripe Services Agreement (collectively, the "Stripe Agreements").

You acknowledge and agree that:

  • Looties is not a bank or payment institution and does not hold user funds.
  • All payments are processed and held by Stripe in the Seller's Stripe Connect account.
  • Looties shall not be liable for any interruption, delay, or error caused by Stripe's services.

5.2. Payout Policy

Looties applies a single security hold designed to protect buyers and sellers and to reduce fraud and chargeback risk.

a) 7-Day Security Hold

  • Funds from a completed sale do not become immediately available.
  • The full sale amount becomes available for payout seven (7) days after the order is completed, meaning:
    • the Buyer confirms delivery, or
    • the order is automatically completed after the applicable auto-completion period.
  • This hold is not a fee and remains the Seller's money. It exists to allow time to detect and resolve refunds, disputes, chargebacks, or delivery issues before funds are released.

b) Automatic Payout

  • Payouts are fully automatic. Once the 7-day hold has elapsed and no issue has been raised, the funds are released to the Seller's connected account without any action required.
  • Looties does not offer a manual or on-demand payout; there is no "request payout" step.
  • A minimum payout threshold may apply; amounts below it accumulate until the threshold is met.
  • Processing times and availability may vary depending on Stripe's requirements and Seller account status.

c) Disputes, Refunds, and Negative Balances

If a Buyer initiates a refund or dispute:

  • The corresponding amount may be deducted from the Seller's available balance.
  • If the Seller's balance becomes negative, Stripe may attempt to recover the amount using the Seller's linked external payment methods.

By using the Service, Sellers expressly authorize:

  • Automatic debit of their connected bank account or debit card to recover negative balances, in accordance with Stripe's policies.

Looties reserves the right to delay or suspend payouts if unresolved disputes or abnormal risk patterns are detected.

d) Instant Payouts

  • Instant payouts are disabled by default.
  • Looties may enable instant payouts for certain Sellers at its discretion, subject to additional eligibility criteria and risk controls.

6. Tax and Legal Obligations

Seller Tax Obligations (French Users): In accordance with French law, users are reminded that income generated from sales on digital platforms may be subject to tax and social security obligations. It is your responsibility to comply with applicable laws.

Import Duties and Customs: Looties does not collect VAT, import duties, or customs fees. All shipments are DDU (Delivered Duty Unpaid). Buyers may be subject to customs charges, import taxes, or duties imposed by their country upon delivery. These fees are the buyer's responsibility and are not included in the purchase price.

7. Cancellations and Refunds

Cancellations and refunds are governed by the applicable Looties platform policies, including the Refund & Cancellation Policy and, where relevant, the Looties Buyer Protection policy, as well as by the contractual relationship between the Buyer and Seller, subject at all times to Looties' rules.

8. Fees

Looties charges a service fee on all transactions. Fees are clearly displayed before you complete a purchase and are non-refundable.

Fee Structure:

  • Service Fee: 1,00 € fixed + 7% of the item price
  • Shipping: Actual cost calculated at checkout based on carrier rates

The current fee schedule, with worked examples, is published on our Pricing page.

9. Disclaimer of Warranties and Limitation of Liability

9.1. "As Is" Service

The Service is provided "AS IS" and "AS AVAILABLE". We expressly disclaim all warranties of any kind, whether express or implied, including the availability of the site or the accuracy of user content.

9.2. Limitation of Liability

To the fullest extent permitted by applicable law (including French Consumer Law):

  • Looties shall not be liable for any indirect, incidental, special, or consequential damages.
  • Looties is not liable for the content posted by Users (including descriptions and photos) or the items sold.
  • Our total liability for any claim arising out of these Terms is limited to the total fees paid by you to Looties in the 12 months preceding the event giving rise to the claim.
  • A Pro Seller is solely responsible towards buyers for its sales, including the right of withdrawal and the legal guarantees. Looties is not a party to those sales.

10. User content and conduct

Before creating or uploading content, you agree that these rules apply to listings, photos, profiles, reviews, messages and every other contribution you make to Looties.

You must not publish or engage in:

  • illegal, counterfeit, fraudulent, sexually exploitative, graphically violent or otherwise unsafe content;
  • harassment, bullying, threats, hate speech, abuse or discrimination;
  • spam, scams, phishing, impersonation, manipulation or repeated unwanted contact;
  • content that infringes privacy, intellectual property or another person's rights.

Use the in-app safety actions to report content, photos, reviews, profiles, conversations or users, and to block another user. You may also contact support@looties.io.

We may remove content, restrict features, suspend or terminate accounts, preserve evidence and cooperate with competent authorities where appropriate. These measures may be taken without prior notice when needed to protect users or comply with law.

11. Termination

We may terminate or suspend your access to the Service at any time, for any reason, without notice, particularly if we believe you have violated these Terms or applicable laws.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of France. In the event of a dispute, users and Looties shall first attempt to resolve the matter amicably. Failing that, the courts of Annecy shall have exclusive jurisdiction, subject to mandatory consumer protection laws.

APPENDIX

Appendix 1 - AI Agents

AI Agents connects third-party personal assistants to your Looties account through the permissions you explicitly approve.

Review the permissions requested by each assistant before connecting it. Access to buying features does not by itself authorize creating, editing or publishing listings. Selling actions require a separate, explicit authorization. You can review and revoke a connection in your AI Agents settings.

You remain responsible for your listings, prices, purchases, sales and shipping obligations under these Terms. Review any AI-generated content before publishing. Purchases prepared by an assistant are completed by you on the secure checkout page. The assistant provider's own terms and privacy policy also apply to its service.

Available actions depend on the assistant and the permissions granted. The general AI Usage Policy in Appendix 2 continues to apply to Looties AI-powered tools.

Appendix 2 - AI USAGE POLICY

1. Scope and Acceptance

This Appendix governs your use of the optional AI-powered tools made available on the Looties platform (the "AI Services"). By checking the consent box in the Terms of Service and/or accessing or using the AI Services, you acknowledge and agree to be bound by this Appendix. If you do not agree with these terms, you must not use the AI Services. You agree that your continued use of the AI Services constitutes acceptance of any future updates to this Appendix.

2. Transparency

In accordance with Article 50 of the EU AI Act, we inform you that when you use the AI Services, your content is processed by an artificial intelligence system.

Inputs

"Inputs" means any content you submit to the AI Services, including images, text, or other materials.

Outputs

"Outputs" means all results generated by the AI Services, which are artificially generated or modified.

Accuracy

AI systems are probabilistic by nature. Outputs may contain inaccuracies, artifacts, or unexpected results. You are solely responsible for reviewing, validating, and deciding whether to use or publish any Output.

3. Data License and Training

By enabling or using the AI Services, you explicitly consent to the following use of your data:

Processing License

By using the AI Services, you grant Looties and its third-party AI processors a worldwide, royalty-free, non-exclusive license to process your Inputs solely for the purpose of generating the Outputs and operating the AI Services.

Model Improvement

You acknowledge and agree that your Inputs and Outputs may be retained and used by Looties and its AI processors to train, validate, and improve AI models.

If you do not wish your data to be used for these purposes, you must not use the AI Services.

4. Ownership

Your Rights

You retain full ownership of your original Inputs and the resulting Outputs generated through the AI Services. You are free to use the Outputs outside of the Looties platform, without restriction.

No Claim

Looties claims no ownership over the intellectual property rights in the content you process using the AI Services.

5. Privacy Constraints

Lawful Content

You agree not to submit Inputs that violate applicable laws or third-party rights.

Prohibited Content

You agree not to upload content containing recognizable faces, biometric data, or sensitive personal information (as defined under the GDPR).

Processor Locations

Our AI providers may process data outside the European Union, including in the United States, under appropriate security safeguards such as Standard Contractual Clauses.

Lawful Use

You represent that you have all necessary rights and permissions to submit the Inputs to the AI Services.

6. Limitation of Liability

Looties provides the AI Services "AS IS" and without warranties of any kind. We are not liable for errors or omissions in processing, data loss, or intellectual property disputes arising from your use of the AI Services.

Appendix 3 - Pro Sellers

1. Who is a Pro Seller

You are a Pro Seller when you sell on Looties in the course of a business, in your own name or through a company: for example if you are a company, brand or reseller, if you buy or source items in order to resell them, or if you sell regularly and in volume so that your sales bring in a substantial income. If this is your case, you must declare it as described in Section 3.2 before listing. You alone are responsible for determining your status and for registering your business and meeting your tax and social obligations.

2. Declaring and Business Details

You declare Pro Seller status by opening your Stripe Connect account as a business account, or by switching it to one, and by completing your business details on Looties: legal name, trading name, registered address, company or trade register number, VAT number if you have one, email address and telephone number. These details are shown on your profile, as the law requires. Your listings are shown as Pro listings once Stripe has verified your business account and your details are complete. You must keep them accurate.

3. The Pro Seller Mark

Pro Sellers are identified by a dedicated mark and the words "Pro seller" on their profile, their listings and at checkout. The mark says that you have declared yourself as a business; it is not an endorsement by Looties. Looties withdraws it if the conditions of this Appendix are no longer met.

4. Right of Withdrawal

A buyer who buys from a Pro Seller as a consumer may withdraw from the purchase for any reason within fourteen (14) days from the day after delivery, as recorded by the carrier or, failing that, by the buyer's confirmation of receipt. The deadline is shown in the order conversation. To withdraw, the buyer uses the "I have a problem" button in the order conversation before the deadline, or sends the Pro Seller the form in Section 8 or any other clear statement.

Returns are shipped with a label provided by Looties, by direct delivery to the Pro Seller; its price is shown to the buyer and paid before the label is issued. The buyer sends the item back within fourteen (14) days of the notice. The buyer is liable for any loss of value caused by handling beyond what is needed to check the item.

The Pro Seller refunds the price of the item and the standard delivery cost without undue delay and no later than fourteen (14) days after being informed of the withdrawal. The refund may be withheld until the item is received or the buyer provides proof of dispatch, whichever occurs first. The buyer may send proof of dispatch to support@looties.io for verification and release of the refund. Both amounts are deducted from the Pro Seller's balance and paid to the buyer by Looties through Stripe; a Pro Seller must never refund a buyer directly. The Looties service fee and the price of the return label are not refunded (Section 6).

The right of withdrawal does not apply to the exceptions provided by law, in particular items made to the buyer's specifications or clearly personalised, and sealed items unsealed after delivery that cannot be returned for hygiene reasons.

5. Legal Guarantees

Items sold by a Pro Seller to a consumer are covered by the legal guarantee of conformity (Articles L. 217-3 and following of the French Consumer Code) and by the guarantee against hidden defects (Articles 1641 and following of the French Civil Code). The guarantee of conformity runs for two (2) years from delivery; for the second-hand items sold on Looties, a defect appearing within twelve (12) months of delivery is presumed to have existed at delivery. The buyer may ask for repair or replacement or, failing that, a price reduction or a refund; the cost of returning a non-conforming item is borne by the Pro Seller. These guarantees are owed by the Pro Seller, not by Looties, and apply in addition to the Looties Buyer Protection. Nothing in these Terms limits the rights that mandatory consumer law gives a buyer against a Pro Seller.

6. Service Fee, Prices and Taxes

The Looties service fee is charged by Looties, not by the Pro Seller, for Looties' own services: secure payment, Buyer Protection and support. It is earned when the order is placed and is not refunded when a buyer withdraws or returns an item, except where Looties itself cancels the order. Fees are the same for all sellers.

A Pro Seller's prices include VAT and all other taxes. The Pro Seller is responsible for invoicing where the law requires it and for collecting and paying VAT and any other tax on its sales. Looties is not the seller of record.

7. Suspension

Looties may suspend or remove a Pro Seller that does not meet this Appendix, and may share a Pro Seller's business details with a buyer or an authority that has a legitimate reason to request them.

8. Model Withdrawal Form

If you are a consumer and purchased an item from a Pro Seller, you may use this form to let the seller know that you wish to withdraw from the sale. Simply complete the information below and send the form directly to the Pro Seller using the chat or the contact details shown on their Looties profile. You do not have to use this form. Any clear statement informing the Pro Seller of your decision to withdraw is sufficient.

To: [Pro Seller's name] I hereby notify you that I wish to withdraw from the contract for the purchase of the following item: Item: [item title] Looties order number: [order number] Ordered on: [date] Received on: [date]
